TERMS OF SERVICE

OVERVIEW

Welcome to Kursi. The terms "Kursi," "we," "us," and "our" refer to Kursi. Kursi operates kursishop.com and all related information, content, features, tools, products, and services offered through the website (collectively, the "Services").

Kursi is powered by Shopify, which enables us to provide the Services.

These Terms of Service, together with our Privacy Policy, Refund and Return Policy, Shipping Policy, and any other policies posted on kursishop.com, describe your rights and responsibilities when using the Services.

Please read these Terms carefully. By visiting, accessing, interacting with, or using the Services, or by purchasing a product, you agree to these Terms and the policies incorporated by reference. If you do not agree, do not use the Services.

SECTION 1 — ELIGIBILITY, ACCESS, AND ACCOUNTS

By agreeing to these Terms, you represent that you are at least the age of majority in your state or jurisdiction of residence or that you have the legal authority to agree to these Terms.

You may be asked to provide information such as your name, email address, billing information, shipping information, phone number, and payment details. You represent that information supplied by you is accurate, current, complete, and lawfully provided.

You are responsible for protecting account credentials and for activity conducted through your account. You may not sell, transfer, assign, or license your account without our written consent.

We may suspend access, refuse service, cancel orders, or terminate accounts when we reasonably believe information is inaccurate, fraudulent, misleading, unlawful, or inconsistent with these Terms.

SECTION 2 — OUR PRODUCTS

Kursi offers consumer household products. Our current primary product is a compact stainless-steel refrigerator deodorizer intended to be placed in a refrigerator or other enclosed household storage space to help manage unwanted odors and support a fresher-smelling storage environment (the "Product").

The Product is made of stainless steel and is supplied as one refrigerator deodorizer box unless a different quantity or bundle is expressly stated in the applicable product listing.

We make reasonable efforts to display product descriptions, specifications, images, dimensions, packaging, color, and appearance accurately. However, screen settings, lighting, manufacturing variations, packaging changes, and photography may cause minor differences.

Images may be illustrative. We do not guarantee that the Product's color, finish, appearance, packaging, or performance will precisely match every image or subjective expectation.

Descriptions, pricing, promotions, specifications, and availability may change without notice. We may discontinue products or limit quantities at any time.

SECTION 3 — PRODUCT PURPOSE, USE, AND CUSTOMER RESPONSIBILITY

The Product is a household odor-management accessory. Use it only for its intended purpose and in accordance with all instructions, warnings, placement guidance, care information, packaging, labels, and product descriptions supplied by Kursi or the manufacturer.

You are responsible for:

• reviewing the product description, specifications, dimensions, instructions, and warnings before purchase and use;
• determining whether the Product is suitable for your refrigerator, enclosed space, household, and intended placement;
• maintaining ordinary refrigerator cleanliness, safe temperatures, proper food storage, and appropriate food-handling practices;
• promptly removing spoiled food, cleaning spills and residue, and addressing the underlying source of persistent odors; and
• keeping the Product in appropriate condition and discontinuing use if it becomes materially damaged, altered, or unsafe.

You must not:

• ingest the Product or treat it as food;
• allow children or pets to play with or ingest the Product;
• disassemble, puncture, crush, modify, tamper with, or use the Product in an unintended manner;
• place the Product in direct contact with unpackaged food unless the instructions expressly state that direct contact is permitted;
• use the Product as a substitute for refrigerator cleaning, temperature control, proper food storage, inspection of food, or disposal of spoiled food; or
• continue using the Product after damage, deterioration, or another condition makes continued use unreasonable.

SECTION 4 — PERFORMANCE, FRESHNESS, AND FOOD-SAFETY DISCLAIMER

The Product is designed to help manage unwanted odors and support a fresher-smelling refrigerator or enclosed storage environment. Results vary depending on refrigerator size, placement, airflow, odor source, temperature, humidity, the amount and type of stored food, cleaning practices, spills, residue, and other household conditions.

Unless Kursi expressly states otherwise in writing and has appropriate supporting evidence, the Product is not represented as a medical device, food-safety device, disinfectant, sanitizer, pesticide, or substitute for approved food-safety practices.

The Product does not:

• guarantee elimination of every odor;
• guarantee that odors will not return;
• guarantee a specific extension of food shelf life;
• make spoiled, contaminated, expired, improperly stored, or unsafe food safe to consume;
• replace refrigeration at a safe temperature;
• replace proper packaging, cleaning, sanitation, or food handling; or
• guarantee the prevention, reduction, treatment, or elimination of bacteria, mold, viruses, parasites, allergens, foodborne illness, spoilage, or any health condition.

Statements about freshness, preservation, odor management, or performance describe the Product's intended consumer purpose and are not a guarantee of identical results in every home.

Always inspect food independently and follow applicable food-safety guidance. When in doubt about the safety of food, discard it.

SECTION 5 — ORDERS

Submitting an order is an offer to purchase. We may accept or reject an order in our discretion, including because of inventory, payment verification, fraud concerns, pricing errors, address problems, shipping restrictions, or other reasonable business reasons.

An order is not accepted until payment is authorized and we confirm or begin fulfillment.

Review your order carefully before submitting it. Because processing begins quickly, we may be unable to accommodate cancellation, address, quantity, or product-change requests.

Purchases are intended for personal or household use and not unauthorized resale, export, or commercial distribution.

SECTION 6 — PRICES, BILLING, AND PAYMENT

Prices, discounts, availability, and promotions may change without notice. The price charged will ordinarily be the price shown when the order is submitted, unless there is an obvious error.

Unless expressly stated, prices may not include taxes, shipping, handling, or other charges. Applicable charges will be displayed at checkout.

You agree to provide accurate and complete billing and payment information and represent that you are authorized to use the payment method supplied.

We may correct pricing, promotional, shipping, description, availability, or other errors and may cancel an affected order. If payment was collected for a canceled order, any required refund will be issued to the original payment method.

SECTION 7 — SHIPPING AND DELIVERY

Shipping and delivery are governed by our Shipping Policy, which is incorporated into these Terms.

Delivery estimates are not guarantees unless expressly stated otherwise. Delays may occur because of carrier operations, weather, customs or logistics issues, address problems, supplier delays, high volume, supply-chain disruptions, or events outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address and for monitoring tracking information.

SECTION 8 — FINAL SALE, REFUNDS, AND REPLACEMENTS

Returns, refunds, replacements, cancellations, and exchanges are governed by our Refund and Return Policy, which is incorporated into these Terms.

All sales are final except where required by law or where Kursi approves a remedy for a timely and verified claim involving a materially damaged, materially defective, incorrect, lost, or undelivered item.

Because the Product is intended for use in refrigerators and enclosed household storage environments, after it leaves our fulfillment process we cannot reliably verify its handling, storage, exposure, use, contamination, or continued condition for resale. Physical returns are therefore not accepted unless Kursi specifically requests one in writing.

SECTION 9 — PRODUCT AVAILABILITY AND CHANGES

We may limit sales by person, household, geographic area, or jurisdiction. We may discontinue or modify a product, bundle, promotion, price, specification, description, or feature at any time.

We do not guarantee continuous availability or that every listing will remain error-free or current at all times.

SECTION 10 — INTELLECTUAL PROPERTY

The Services and their content, including text, graphics, branding, logos, icons, images, video, audio, product descriptions, designs, layout, code, and software, are owned by or licensed to Kursi and are protected by applicable intellectual-property laws.

You may use the Services only for personal, non-commercial purposes. Without prior written permission, you may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, scrape, store, transmit, exploit, or commercially use content from the Services.

Kursi names, logos, and branding may not be used without written permission. Nothing in these Terms represents that a name or mark is federally registered unless expressly stated.

Shopify and third-party names and marks belong to their respective owners.

SECTION 11 — OPTIONAL TOOLS AND THIRD-PARTY SERVICES

We may provide access to tools, content, integrations, or services operated by third parties. These are provided on an "as is" and "as available" basis without endorsement or control by Kursi.

Your use of third-party tools or services is at your own risk and may be governed by separate terms and privacy policies.

New features, tools, products, or resources added to the Services are also subject to these Terms unless stated otherwise.

SECTION 12 — THIRD-PARTY LINKS

The Services may link to third-party websites or content. Kursi does not control and is not responsible for their content, accuracy, availability, privacy, security, products, services, or practices.

Accessing or purchasing from a third party is at your own risk. Questions or claims regarding third-party products or services should be directed to the applicable third party.

SECTION 13 — RELATIONSHIP WITH SHOPIFY

The Services are powered by Shopify. Purchases from kursishop.com are transactions directly between you and Kursi, not Shopify.

To the fullest extent permitted by law, Shopify is not responsible for product performance, injury, damage, refunds, replacements, delivery issues, customer support, or disputes arising from a transaction with Kursi.

Nothing in this section limits a right that cannot lawfully be waived.

SECTION 14 — PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy, which is incorporated into these Terms.

Shopify and other service providers may process information to operate the store, checkout, payments, fraud prevention, analytics, fulfillment, advertising, and related services.

By using the Services, you acknowledge the privacy practices described in our Privacy Policy.

SECTION 15 — FEEDBACK, REVIEWS, AND USER CONTENT

If you submit a review, testimonial, photograph, video, idea, suggestion, feedback, proposal, or other content, you grant Kursi a worldwide, non-exclusive, royalty-free, transferable, sublicensable, perpetual license to use, reproduce, modify, adapt, publish, translate, distribute, display, and otherwise use that content for lawful purposes, including marketing.

You represent that you own or control the rights needed to submit the content, that it is accurate to the best of your knowledge, and that it does not violate law, these Terms, or another person's rights.

We may monitor, edit, refuse, or remove content that we consider unlawful, misleading, infringing, abusive, obscene, defamatory, fraudulent, or otherwise objectionable.

SECTION 16 — ERRORS, INACCURACIES, AND OMISSIONS

The Services may occasionally contain typographical errors, inaccuracies, omissions, or outdated information relating to descriptions, prices, promotions, shipping, transit times, availability, or other matters.

We may correct or update information and cancel affected orders at any time, including after an order is submitted. If an order is canceled after payment, we will provide any refund required by law or our policies.

SECTION 17 — PROHIBITED USES

You may not use the Services:

• for an unlawful, fraudulent, deceptive, abusive, or malicious purpose;
• to violate any law, regulation, rule, or ordinance;
• to infringe the rights of Kursi or another person;
• to harass, threaten, defame, abuse, or harm another person;
• to transmit false, misleading, or fraudulent information;
• to distribute spam, phishing attempts, malware, or harmful code;
• to scrape, harvest, copy, extract, or collect content or data without authorization;
• to use bots, crawlers, automated agents, or similar systems in a manner that interferes with or circumvents the Services;
• to probe, disable, bypass, or interfere with security or operation; or
• in a way that exposes Kursi, Shopify, customers, or others to harm or liability.

We may restrict or terminate access where we reasonably believe these Terms were violated.

SECTION 18 — TERMINATION

We may suspend or terminate access to the Services or an account, in whole or in part, when reasonably necessary to protect the Services, enforce these Terms, prevent abuse or fraud, or comply with law.

You remain responsible for obligations and amounts due before termination.

Provisions that by their nature should survive termination will survive, including intellectual property, product responsibility, disclaimers, limitations of liability, indemnification, governing law, and dispute provisions.

SECTION 19 — DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Services and Products are provided "as is" and "as available," without warranties or conditions of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, durability, and non-infringement.

We do not guarantee:

• uninterrupted, secure, timely, or error-free access to the Services;
• elimination of every refrigerator or enclosed-space odor;
• a particular duration or level of odor reduction;
• a specific extension of food freshness or shelf life;
• antibacterial, antimicrobial, sanitizing, disinfecting, or health-protective results;
• suitability for every refrigerator, space, food-storage method, household, or preference; or
• that results will be identical to photographs, demonstrations, descriptions, or another customer's experience.

Some jurisdictions do not permit certain warranty exclusions, so some exclusions may not apply to you.

Nothing in these Terms excludes an express written warranty offered by Kursi, if any, or a legal warranty or consumer right that cannot be waived.

SECTION 20 — LIMITATION OF LIABILITY

To the fullest extent permitted by law, Kursi and its owners, officers, directors, employees, affiliates, agents, contractors, suppliers, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost revenue, loss of data, replacement costs, food loss, or similar damages arising from the Services or Products.

Without limiting the foregoing, and to the fullest extent permitted by law, Kursi is not liable for loss or damage resulting from:

• misuse, alteration, tampering, unintended use, or failure to follow instructions;
• using the Product as a substitute for cleaning, food inspection, temperature control, food-safety procedures, or proper storage;
• consumption of expired, spoiled, contaminated, improperly stored, or unsafe food;
• failure to remove the source of an odor, clean spills, address mold, or maintain the refrigerator;
• improper placement, handling, storage, or cleaning of the Product;
• unauthorized claims or instructions made by a third party; or
• continued use after the Product becomes materially damaged or unsuitable.

To the fullest extent permitted by applicable law, Kursi's total aggregate liability for a claim arising from a Product will not exceed the amount actually paid to Kursi for the Product giving rise to the claim.

Nothing in these Terms excludes or limits liability or consumer rights that cannot legally be excluded or limited, including liability for personal injury where applicable law prohibits its exclusion.

SECTION 21 — INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify and hold harmless Kursi, Shopify, and their respective affiliates, owners, officers, directors, employees, agents, contractors, licensors, suppliers, and service providers from claims, losses, liabilities, damages, judgments, costs, and reasonable legal fees arising from:

• your breach of these Terms or a policy incorporated by reference;
• your violation of law or another person's rights;
• your unlawful, fraudulent, negligent, reckless, or intentional conduct; or
• your misuse of the Services or a Product.

We may control the defense of a matter subject to indemnification, and you agree to cooperate reasonably.

SECTION 22 — SEVERABILITY

If a provision of these Terms is held unlawful, void, invalid, or unenforceable, it will be enforced to the maximum extent permitted and the unenforceable portion will be severed without affecting the remaining provisions.

SECTION 23 — WAIVER AND ENTIRE AGREEMENT

Failure to enforce a right or provision is not a waiver of that right or provision.

These Terms and the policies posted on the Services constitute the entire agreement between you and Kursi regarding the Services and supersede prior communications or agreements concerning the same subject.

SECTION 24 — ASSIGNMENT

You may not assign, transfer, or delegate these Terms or related rights or obligations without our prior written consent.

We may assign or transfer these Terms and our rights and obligations as part of a business transaction or as otherwise permitted by law.

SECTION 25 — GOVERNING LAW AND VENUE

These Terms and disputes arising from the Services, an order, or a Product are governed by the laws of the State of Virginia, without regard to conflict-of-law principles.

Subject to applicable consumer-protection law and any right that cannot be waived, legal proceedings shall be brought in the state or federal courts located in or serving Henrico, Virginia, and you consent to their jurisdiction and venue.

SECTION 26 — CHANGES TO THESE TERMS

We may update these Terms by posting a revised version on kursishop.com. Where required, we will provide additional notice of material changes.

Your continued use of the Services after the effective date of revised Terms constitutes acceptance to the extent permitted by law.
